Driveways and Curbing
ORDINANCE No. G09-01
AN ORDINANCE PROVIDING FOR THE OBTAINING OF BUILDING PERMITS FOR THE CONSTRUCTION AND/OR ALTERATION OF DRIVEWAYS AND CURBING AND PROVIDING PENALTIES FOR THE VIOLATION THEREOF.
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF EASTBOROUGH, KANSAS:
SECTION 1.
The Building Supervisor appointed by the Mayor of the City of Eastborough pursuant to Ordinance 1182 is hereby given full supervision and control over the issuance of permits for the construction and/or alteration of driveways and curbing in the City of Eastborough.
SECTION 2.
It is unlawful for any person to construct and/or alter a driveway or curbing in the City of Eastborough that interfaces with a city street without first obtaining a permit from said Building Supervisor. Any person contemplating the construction and/or alteration of a driveway or curbing in said City of Eastborough shat submit the construction documents to said Building Supervisor and deposit the fee hereinafter provided at least ten (10) days before planned construction. Said Building Supervisor will examine such construction documents and ascertain whether they meet requirements of acceptable workmanship in the construction and/or alteration of said driveway and/or curbing and the interface with city streets. If said Building Supervisor finds that such plans and specifications do meet said requirements, then upon the payment of the fee hereinafter provided, the Building Supervisor shall grant the permit.
SECTION 3.
At the time said construction documents are submitted to the Building Supervisor, applicant shall pay the City Clerk a document review and administration fee in the amount of $200.
SECTION 4.
Any person who shall begin construction for which a permit is required without first having obtained a permit from the Building Supervisor shall be guilty of a misdemeanor and be fined not less than $100 or more than $1000 and/or shall be subject to being enjoined from the completion thereof.
SECTION 5.
This ordinance shall take effect and be in force from and after its publication in the official city newspaper.
