ORDINANCE NO. G22-03
AN ORDINANCE REPEALING ORDINANCE G12-05, PROVIDING FOR THE OBTAINING OF BUILDING PERMITS FOR THE CONSTRUCTION AND/OR ALTERATION OF BUILDINGS AND PROVIDING PENALTIES FOR THE VIOLATION THEREOF BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF EASTBOROUGH, KANSAS
SECTION 1. Ordinance No. G12-05 is hereby repealed.
SECTION 2. It is hereby declared that a Building Supervisor be appointed by the Mayor of the City of Eastborough and be given full supervision and control over the matter of the issuance of permits for the construction and/or alteration of residences and other structures in the City of Eastborough.
SECTION 3. It is unlawful for any person to construct or demolish a residence or other structure in the City of Eastborough without first obtaining a permit from said Building Supervisor. Any person contemplating the construction of a residence or other structure in said City of Eastborough shall submit the construction documents, including a site plan locating property boundaries, set back lines and public and private easements, including utilities, to said Building Supervisor and deposit the fee hereinafter provided at least ten days before planned construction. Said Building Supervisor will examine such construction documents and ascertain whether they meet the requirements of all ordinances of the City of Eastborough. If said Building Supervisor finds such plans and specifications meet said requirements, then upon payment of the fee hereinafter provided, the Building Supervisor shall grant the permit.
Any person contemplating the demolition of a residence or other structure in the City of Eastborough shall submit the demolition documents to said Building Supervisor and deposit the fee hereinafter provided at least ten days before planned demolition. Said Building Supervisor will examine such demolition documents and ascertain whether they meet the requirements of all ordinances of the City of Eastborough. If said Building Supervisor finds such plans and specifications meet said requirements, thenon payment of the fee hereinafter provided, the Building Supervisor shall grant the permit.
SECTION 4. Where an alteration, extension or addition is made to a home or structure in the City of Eastborough which will cause a change in the exterior walls of the house or change in the exterior dimensions or exterior lines of the house, said change shall not be made until an application is made to the Building Supervisor requesting permit for such change. Said request shall be accompanied by construction documents as set forth in Section 3 and, in addition, the original dimensions of the house and the change requested. The procedure shall be as set forth in Section 3.
Where a demolition is requested to be made to a home or structure in the City of Eastborough which will cause a change in the exterior walls of the house or change in the exterior dimensions or exterior lines of the house, said demolition shall not be made until an application is made to the Building Supervisor requesting permit for such change. Said request shall be accompanied by demolition documents as set forth in Section 3 and, in addition, the original dimensions of the house and the change requested. The procedure shall be as set forth in Section 3.
SECTION 5. Applicant shall only employ contractors that are licensed to perform construction, alterations, or demolitions for which a permit has been issued.
SECTION 6: A permit fee due at time of application for the project and document review is as follows:
A. Fence $200.00
B. Remodel or addition to existing structure $300.00
C. New residence $400.00
D. Demolition $200.00
E. Other structure $200.00
SECTION 7. Any person who shall begin construction for which a permit is required without first having obtained a permit from the Building Supervisor shall be guilty of a misdemeanor and be fined not less than $100 or more than $1000 and/or shall be subject to being enjoined from completion thereof.
SECTION 8. Permits shall become null and void if work has not started within 90 days, or if work is suspended or abandoned for 90 days.
SECTION 9. An accessory building of no more than 250 square feet without a foundation is not subject to this ordinance and does not require a building permit nor a fee.
SECTION 10. This ordinance shall take effect and be in force from and after its publication in the official city newspaper.
