Restrict Placing Yard Waste in Street
Banning Rubbish – Ordinance No. 1271
AN ORDINANCE BANNING THE PLACEMENT OF GRASS, LEAVES AND OTHER RUBBISH INTO THE STREET
BE IT ORDAINED BY THE GOVERINING BODY OF THE CITY OF EASTBOROUGH, KANSAS:
Section 1.
The owner and/or occupant of any lot within the City of Eastborough, Kansas shall not allow the raking, sweeping, blowing, or otherwise moving of grass, leaves, dirt, sticks, paper and other debris into the gutters or drainage ditches along the sides of any street in the city, without removing the same immediately thereafter.
Section 2.
Upon a determination by the compliance officer, that any owner fails to comply with or violates any provision of this Ordinance, the said compliance officer shall give the owner seven (7) days to remove the debris from along the side of the street.
Section 3.
After notice from the said compliance officer, if the owner fails to comply with this Ordinance the owner shall be deemed guilty of a misdemeanor, and upon first conviction the owner of the lot shall be punished by a fine not exceeding $50.00; any subsequent conviction of the same person shall be punished by a mandatory fine of $100.00 for each offense.
Section 4.
This ordinance shall take effect and shall be in full force from and after it passage and publication once in the official paper.
