Fencing Swimming Pools – Ordinance G11-03
AN ORDINANCE RELATING TO FENCING SWIMMING POOLS.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EASTBOROUGH, KANSAS:
Section 1:
“Swimming pool” means any structure, basin, chamber or tank which may contain water and has a depth of two feet or more at any point, empty or filled.
Section 2:
Swimming pools shall be enclosed with a fence at least sixty inches in height. Opening in said fence shall not allow greater than a 4″ diameter sphere. Gates leading to such pools shall be latched when not under supervision of an adult. Such latch shall reasonably ensure against accidental access to the pool.
Section 3:
In lieu of fencing, a swimming pool may be enclosed, when not under the supervision of an adult, by means of a power safety cover meeting the most recent specifications approved by the American Society for Testing and Materials for swimming pool covers.
Section 4:
Any person violating any of the provisions of this ordinance is guilty of a misdemeanor and, upon conviction, shall be punished by a fine of not more than $1000.
Section 5:
Any person receiving written notice of a violation of this Ordinance shall have ten (10) days to become compliant.
Section 6:
This ordinance shall take effect and be in full force from and after its passage and publication one time in the official city newspaper.
